These Terms and Conditions (“Terms”) govern your use of the Spectrum Analytics website at spectrumanalytics.org and the purchase of online training courses and services offered by Spectrum Analytics Consulting Inc., a Florida Profit Corporation (“Spectrum Analytics,” “we,” “us,” or “our”). By accessing our website or purchasing a course, you agree to be bound by these Terms.
1. Services Offered
Spectrum Analytics offers (a) clinical ABA therapy services in Miami-Dade County, Florida, governed by separate service agreements and Florida law; and (b) online professional training courses for Registered Behavior Technician (RBT) certification, continuing education, and caregiver training. These Terms apply primarily to the online training and course purchases. Clinical services are governed by your individual service agreement and our Notice of Privacy Practices.
2. Course Purchases and Payment
All course purchases are processed through our secure payment processor. Prices are listed in US dollars. By completing a purchase, you represent that you are authorized to use the payment method provided. Course access is granted upon successful payment confirmation. We reserve the right to modify pricing at any time; changes will not affect purchases already completed.
3. Refund Policy
Digital course purchases: Refunds are available within 7 days of purchase if you have completed less than 20% of the course content. No refunds are issued after 7 days or after more than 20% of course content has been accessed. RBT Competency Assessment bookings: Non-refundable once scheduled. If you need to reschedule, contact us at least 48 hours before your appointment; one reschedule is permitted at no charge. Subscription plans (RBT Study Platform): Cancel anytime; you retain access until the end of your current billing period. No partial refunds for unused subscription time.
4. BACB Disclaimer
Spectrum Analytics is not affiliated with, endorsed by, or approved by the Behavior Analyst Certification Board (BACB). Board Certified Behavior Analyst®, BCBA®, BCaBA®, RBT®, and BACB® are registered trademarks of the Behavior Analyst Certification Board. Our 40-hour RBT training is designed to meet BACB eligibility requirements but does not guarantee certification. Certification decisions are made solely by the BACB.
5. Intellectual Property
All course content, materials, videos, assessments, and website content are the intellectual property of Spectrum Analytics Consulting Inc. and are protected by copyright law. Your purchase grants you a limited, non-exclusive, non-transferable license to access course materials for your personal use only. You may not reproduce, distribute, resell, share login credentials, or create derivative works from our content without prior written permission.
6. Limitation of Liability
To the fullest extent permitted by Florida law, Spectrum Analytics shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or courses. Our total liability for any claim arising from a course purchase shall not exceed the amount you paid for that course. Nothing in these Terms limits our liability for gross negligence, willful misconduct, or personal injury.
7. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
8. Changes to Terms
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms. For purchases already completed, the Terms in effect at the time of purchase apply.
